What does the Crofting Commission do?
Under the Crofting Reform (Scotland) Act 2010, the Crofting Commission is responsible for crofting regulation in Scotland. We’re responsible for the registration of crofts.
How long does it take to Decroft land?
How long does the decrofting process for a new house take? Providing your croft is registered with the Keeper of the Registers of Scotland, we aim to take a decision on the application within 16 weeks. If your croft is not registered, we cannot take a decsion on your application until this has happened.
What is a crofting tenure?
Crofting is a form of land tenure which is unique to Scotland. A croft is a relatively small agricultural land holding which is normally held in tenancy and which may or may not have buildings or a house associated with it.
How do you become a crofter?
You can become a crofter by:
- buying a croft – that is presently owner-occupied and becoming an owner-occupier.
- becoming a tenant – for example, renting a vacant croft or a crofter transfers their tenancy to you.
- subletting – from a tenant crofter for a limited time.
How do crofters make a living?
Most crofters don’t make a living from the land, but have other sources of income as well, such as part-time or full-time employment, or running their own businesses.
Can you get a mortgage on a croft?
In order to acquire a croft, whether or not it is a tenancy or owner-occupied, the purchaser has to come up with 100% of the funds. There are no mortgages available to buy the land.
Do crofters pay rent?
As a crofter, you only pay rent for the land. You don’t pay rent for any house, buildings, fences, roads or other structures on the land because they belong to you. If you can’t agree on the rent with your landlord, you have the right to apply to the Land Court for a fair rent to be set.
Can I build a house on a croft?
Crofting legislation entitles a crofter to build a croft house on the croft, subject to planning consent. In almost every case the croft house must be provided by the crofter themselves.

You technically need PP to have people staying in a caravan parked on your driveway, although it would hard to enforce this if it wasn’t obvious to passers by.

SCF chief executive, Patrick Krause, said: “The 2010 Crofting Act gave the Crofting Commission more powers to reject decrofting applications. The notes that accompany the Act say these powers have been granted in order ‘to tackle speculation on the development value of croft land’.
